So just so I understand here…are we suggesting that @NewYorkCity76 has shared some form of exclusive marketing/promotional kit here? Honestly that seems like a non-sequitur, but I suppose if people are willing to sit thru an 8 hours time-share presentation in exchange for a “free” 24-hour vacation, anything is possible.

The context I believe is that the 175parkavenue​​.​com site is password protected, presumably for presentation to prospective tenants only, but the password wall wasn’t perfect and some of the media from the website was able to leak through. NYC76’s link is a reupload of one of the leaked videos (uploaded by someone else).

Without an official release, there may be potential for intellectual property trouble if too much of that leaked content gets rehosted here or elsewhere public so Mackensen has a point in being cautious for the forum’s sake.

Wouldn’t the New York YIMBY articles of 270 Park and 2 WTC leaks also fall under that context? That’s why I’m so confused about this, we got lots of leaks on the forums as well (but we aren’t the Oculus)

Ground floor is probably about 1 and 1/3 acre. Will the building be more than 25% slimmer at the top habitable floor compared to the ground floor?

This building could potentially be the most amazing thing on the NYC skyline. The crown lighting is out of this world.

There is absolutely no chance that YIMBY would be found in violation of copyright. Zero. If they are so inclined, the true rights holders can assert their copyright and lodge a claim with YouTube, and YouTube will have the clip(s) removed (I’ve actually initiated these claims as part of my day job…we use a law firm that specializes in YouTube takedowns).

Now if the person who originally posted these to YouTube were to be teased out by the firm, then I can see that person getting fired but the risk to YIMBY is seriously zero.

The sharing of news and information is protected under the 1st Amendment of the United States Constitution. Luckily that document is still in force, at least until the end of 2024.

In all fairness,I don’t think any one person is personally liable in this case, compared to 270 Park, 2WTC and 520 Fifth where someone actually working with the project uploaded material without permission. I imagine the most that will happen here is RXR fixes the site’s bug.

Is it still safe if YIMBY were hosting copyrighted images on its own servers? I would have imagined it would be the same as uploading a movie to YouTube, but as TK2000 mentioned, previous leaks were fine to stay on YIMBY and other forums. The only example I can think of right now is this Archinect article about a Zaha Hadid design where the rendering was later removed voluntarily:

The YouTube upload is from another forum member, not anyone with the project. As of right now, anyone can actually access that video from the 175parkavenue website themselves with a bit of digging.

Caution is warranted, but we shouldn’t confuse people with vague ideas about how copyright law applies. As a creator, I fully support the legal framework that grants me the ability to enforce my property rights, but I equally value freedom of speech (and the fair use doctrine) that keeps me informed about what’s happening in my own backyard. I mean, this may be a global forum but YIMBY is incorporated in the USA, and in the democratic system, we are compelled to consider both the private interest and the public interest.

New York Yimby is an LLC registered in the state of New York - that LLC is a form of legal protection (Limited Liability Corporation), so the site owners have to assess those risks for themselves. I’m just saying that sharing a YouTube link is not a risk anyone needs to worry about.

I agree with you that sharing the YouTube link should be no problem at all for the forum. The only thing I’d be wary of is hosting screenshots or other images on the forum itself — there are actually some renderings on the website that can be accessed the same way as the trailer video.

I agree. If it’s public on YouTube, anyone should be free to share that link (or embed the video) here and anywhere else. If it shouldn’t be public on YouTube, that’s an issue for YouTube and that YouTube account holder, not people sharing the link to YouTube. Maybe the video should be taken down or set to private, (or maybe not, it seems weird to just assume it shouldn’t be public,) but as long as it’s up and public, we should be able to share it.

Morgan Stanley URL could be interesting. If they want to keep up with their competitors they’ll need to make a move soon.1585 Broadway is a really less than prestigious location, right in the middle of Times Square. They considered Hudson Yards a number of years back.
Don’t know much about Bloomberg’s situation.
